| 摘要 | 《心靈的交會——山間對話》中釋昭慧法師與哲學家彼得·辛格討論動物福利的問題：如何在公共領域實現對於萬物的平等考量？平等考量的標準在哪？是否在於可感知痛苦快樂的能力？這種能力是否隨著不同人而改變，並因此造成物種之間的差別對待？關於這些棘手的問題，本文希望挪用 Martha C. Nussbaum的能力取徑(Capabilities Approach)給這個動物倫理的問題一個不同視角。如果動物福利的問題要進入公共的議題或作為正義的部分，要如何形構？這裡涉及道德主體（人）的苦樂感知靈敏度問題，並且如何將涉及的判準納入正義的制度設計中，從而保護道德受體（動物）的福利？如果主觀的感知靈敏度只能在私領域發揮作用，則在正義的領域就必須要求更客觀的標準，能力取徑對於涉及動物正義的重疊共識可以提供更好的構想。 In Meeting of Minds: Dialogues in the Mountain, Ven. Shih Chao-hwei and philosopher Peter Singer discuss the issue of animal welfare: how to achieve equal consideration for all beings in the public sphere. What is the standard for equal consideration? Is it based on the capacity to perceive pain and pleasure? Does this capacity vary among individuals and consequently result in differential treatment of species? This article aims to offer a different perspective on this ethical issue in animal ethics by drawing upon Martha C. Nussbaum's capabilities approach. If the issue of animal welfare is to become a public concern or a part of justice, how should it be constructed? This involves the question of moral agents' (humans') sensitivity to suffering and pleasure and how to incorporate the relevant criteria into the design of a just system to protect the welfare of moral patients (animals). If subjective sensitivity can only operate in the private domain, then more objective standards must be demanded in the realm of justice, and capabilities approach can provide a better framework for overlapping consensus on animal justice issues. |
