| 摘要 | 인간은 “사회”라는 공동체의 구성원으로서 상호관계를 이루고 있다. 이러한 사회를 유지, 존속하기 위해선 정당화된 사회규범이 존재하여야 한다. “정당화”란 사회규범을 지켜야 할 이유와 근거라 할 수 있다. 승 가 또한 공동체로서 정당화된 규범이 존재한다. 즉, 승가에선 규범으로 서 율이 존재하며, 오늘날 한국사회에는 사회규범으로서 법이 존재하고 있다. 이러한 규범은 고정불변의 것이 아닌 그 시대의 구성원들의 종교, 법, 도덕, 관습 등의 가치관에 의해서 조정되는 것이다. 그런 점에서 율 제정당시의 가치관과 오늘날 한국사회의 가치관의 차이와 율 조항의 문 자에 얽매인 나머지 논란이 되고 있다. 하지만, 그것은 부처께서 율을 제정하신 목적을 이해하기 앞서 문자 상으로 얽매여서 일어난 논란이 대부분이다. 승가와 사회와의 관계는 제정 당시에도 볼 수 있듯이 상호 관계 속에서 변화, 발전함을 알 수가 있다. 그럼에도 불구하고, 규범으 로서 그 시대의 가치관을 반영치 못한다면, 규범으로서 존재하기가 어 려울 것이다. 하지만, 무작정 변경이 아닌 율 조항의 문자에만 얽매이지 않고 인연담을 통해 율의 제정목적을 이해하는 것이 우선되어야 한다. 그런 다음 한국사회의 가치관에 맞게 정법으로서 수정, 보완하여 승가 규범과 한국사회와의 조화로운 상호관계를 이뤄야만 승가가 존속, 발전 할 수 있을 것이다. Human forms relationship as a member of community called “society”. Justified social norm should exist to keep and retain this society. “Justification” can be regarded as the cause and grounds to keep social norms. Justified norms also exist in the Samgha. That is, religious precept exists as norms in the Samgha and Vinaya exists in Korean society as the social norms. Such norms are not fixed but adjusted by the value system such as religion, law, ethics and custom of members of the times. In that regard, there exists difference in values system of the time when religious precepts were established and that of Korean society, today and bound by the letter of precept. However, most controversy occurred regarding letters before understanding the purpose that the Buddha established the Vinaya. Relationship between the Samgha and society has been changed and developed under mutual relationship as can be seen at the time of establishment. Nonetheless, if it fails to reflect the value system of the times as a norm, it must be difficult to exist as a norm. However, it should give priority to understand the purpose of establishing precept through the story of causation without being bound by the letter of articles of precept rather than blind change. Then, Samgha may continue to exist and develop only when harmonic correlation is formed between norms of Samgha and Korean society by modifying and complementing it as the formula that matches the value system of Korean society. |
