| 摘要 | 서구사회에서 동물의 권리 내지는 해방론이 대두된 것은 그들의 전통적 동물관이 수정되고 있음을 뜻한다. 인간은 동물을 임의로 사용할 수 있다고 생각했던 서양인들의 인간중심주의적 사고방식은 유대-기독교적 전통으로까지 거슬러 올라가는 오랜 역사를 가지고 있다. 그러나 1970년대 중반 제기된 피터 싱어의 동물해방론은 이런 서양인들의 전통적 윤리의식을 근본적으로 뒤흔들어 놓았다. 이 논문은 싱어의 문제제기 이후 전개된 일련의 동물권리 논쟁들을 간략하게 정리해 본 것이다. 동물의 권리와 관련된 논의들은 크게 동물해방 또는 복지론과 동물권리론으로 나누어진다. 싱어의 이익동등고려의 원리는 전자를, 그리고 레건의 내재적 권리론은 후자의 입장을 각각 대표한다. 동물해방(복지)론이 동물들의 현실적 고통을 제거하고자 한다면, 동물권리론은 모든 동물의 내재적 가치를 강조하고 있다는 점에서 후자는 전자 보다 훨씬 더 급진적이다. 본문에서는 이 문제에 대한 찬반양론들이 자세하게 소개되고 있다. 끝으로 필자는 동물의 권리 논쟁도 궁극적으로는 생태계 전체의 관점에서 이해되고 조명될 수밖에 없을 것이라는 환경론자들의 견해를 소개하면서 결론을 대신하고 있다. 참고로 목차를 보면 논지의 전개과정과 내용 및 언급되고 있는 학자들의 입장을 대강 추정해 볼 수 있을 것이라고 생각한다.2 The fact that the movements of animal’ rights or liberation had been raised in the west society means that the Western traditional view of animals has been changing. Western people had traditionally thought that human beings could use animals arbitrarily for their purpose and this way of thinking goes back to the Judaic-Christian tradition in the past. However, Peter Singer’ slogan of animal liberation had radically stirred the traditional ethical consciousness of Westerners. This essay is dealing with the developmental process of arguments concerning animal rights after Peter Singer. It is divided into the two main stream, that is to say, the theory of animal liberation or welfare and the animal’s rights theory. The principle of equal consideration of interests by Singer represents the first, and then the theory of animals’ innate rights by Tom Regan represents the second respectably. While liberationists or welfarists are trying to get rid of some actual pains of animals, the animal rightists stresses the innate value or right of animals. In this respect the second position is much more radical than the first one. Most arguments for and against regarding this problem are in detail explained in the essay. Finally I conclude my essay by introducing the environmental position which the problem of animal rights or welfare are ultimately to be solved in the ecological view points of nature. |
