摘要본 논문은 고대 한국불교에서 불교의 오계(五戒) 가운데 첫 번째에 해당하는 불살생계(不殺生戒)가 정치적 상황에 따라 어떻게 적용되는지에 대해 고찰하였다. 즉 불교에서 오계는 불교도가 지켜야 할 중요한 생활의 지침[법]이지만, 결코 고정된 것이 아니라 연기적 상황에 따라 달리 해석되어질 수 있음을 신라불교, 특히 불살생계에 대한 원효(元曉, 617~686)의 해석을 통해 살펴보았다. 원효의 불살생계에 대한 해석은 당시의 시대상황을 극복하기 위한 것으로 그의 독자적인 철학적 관점을 보여준다.
불교가 도입되던 고대 한국사회는 세 나라[고구려, 백제, 신라]로 분열되어 한반도를 피로 물들이던 전쟁의 시대였다. 그런데 세 나라 모두 불교를 국교로서 받아들였지만 현실적 여건은 불살생의 계율을 그대로 지킬 수 없는 상황이었다. 만약 불살생계를 지킨다면 전쟁에서 패배하여 나라를 빼앗길 수밖에 없는 처지였던 것이다. 이때 삼국 중 살생과 불살생의 모순에 대해 가장 빠르게 나름대로의 윤리적 지침[법]을 제시한 나라는 신라이다. 신라의 원광법사(圓光法師, 542~640)는 유교의 오륜(五倫)에 토대하여 일반인들을 위한 세속오계(世俗五戒)를 제시하였다. 즉 ① 임금을 충성으로 모시고, ② 어버이에게 효도하고, ③ 벗은 신의로 사귀며, ④ 전쟁에 임하여 후퇴하지 말며, ⑤ 산 것을 죽이되 가려서 하고 경솔히 하지 마라는 것이다.
불교의 오계 중 첫 번째를 차지하였던 ‘살생을 하지 마라’는 불살생의 계율은 세속오계의 마지막에 위치하며, 그것도 ‘가려서 죽여라’이다. 전쟁에 임하여 후퇴하지 말고 가려서 죽이라고 하는 것은 결국 자신의 목숨을 걸고 적군을 죽이라는 것과 다를 바 없다. 다시 말해 불살생의 계율을 살생의 계율로 윤리적으로 합법화 한 것이라고 볼 수 있다. 그것은 다름 아닌 세속오계의 첫 번째 항목인 민족과 국가, 즉 임금을 위해 자신의 목숨을 바쳐 적군을 죽이라는 윤리적 지침을 법[다르마]으로서 정립한 것이다.
원효는 한국이 낳은 가장 위대한 승려로 평가된다. 무엇보다 그는 당시의 정치적인 상황을 고려하여 불살생계에 관한 여러 해석을 독자적인 관점에서 종합하였다. 그 결과 원효는 ‘살인을 하더라도 하나같이 복이 될 수도 있다’는 사생관을 제시함으로써 그가 의도하였든 그렇지 않든 간에 국가와 민족을 위한 ‘살인’은 정당화 될 수 있다는 지침[법]을 마련한 것이다. 이러한 사생관의 밑바탕에는 불국토 건설이라는 호국불교의 이념이 자리하고 있다. 즉 신라불교의 이념적 토대는 전륜성왕이라는 왕을 기점으로 하여 불국토(정토) 건설을 정치적 목표로 하였던 것이다.
원효가 불살생계를 살생계로 정당화 할 수 있었던 그의 사상적 근거는 일심(一心)과 화쟁(和諍), 그리고 무애(無碍)이다. 세속의 모든 일은 한 마음의 작용에 지나지 않은 것으로, 일체의 갈등을 걸림 없이 화해시키는 논리와 실천이 바로 그 세 가지이다. 본 논문에서는 그러한 원효의 사상적 체계가 정치적 상황에 따라 어떻게 해석되며 적용되는지를 살펴봄으로써 법의 연기적 성격을 규명하고자 하였다. 즉, 불교에 있어 법[다르마]은 고정되어 있는 것이 아니라 인연[연기]에 따라 달리 해석되어지는 것이다.


This paper study how the first Un-killing precept(不殺生戒) of five commands refers to in political situation through Korean Buddhism. Dharma in Buddhism doesn’t fixed, and it is appeared most proper teaching from considering of several conditions of Pratityasamutpada(緣起) on Wonhyo’s interpretation of Un-killing rule. Wonhyo’s interpretation of Un-killing precept was to overcome the times and circumstances, and it was from his own independent and philosophical view.
When Buddhism was introduced, the ancient Korean society was divided into three countries (Gogooroe, Baekje and Shilla) and was in the middle of the age of war, rendering the Korean peninsula gory. The era of three countries in ancient Korea was war-torn and they couldn't help but kill to live. The three countries all accepted Buddhism as a national religion but could not keep Un-killing precept(不殺生戒) as it was. If they had kept Un-killing precept(不殺生戒), they would have been defeated in the war and lost their countries.
Five commandments for secular life and the commandment of selective killing of the living by Wongwang(圓光:A.D.555-638): It was Shilla, ahead of the two other countries, that suggested ethical guidelines to deal with the contradiction between prohibiting killing and accepting killing. Wongwang, the teacher Buddhist monk, suggested Five commandments for secular life, based on five moral rules in Confucianism. That is: 1 Be loyal to your king. 2 Be dutiful to your parents. 3 Be faithful to your friends. 4 Do not retreat in the war. 5 Kill living things selectively but don't be imprudent.
Un-killing precept(不殺生戒), which was paramount among the Five commandments in Buddhism, became drawn back to the last among the five commandments for secular life. Even it says, ‘Kill selectively’. ‘Kill selectively in the war’ was not different from ‘risk your life and kill the enemy’. It was an attempt to ethically legitimize a commandment of killing, replacing Un-killing precept(不殺生戒). It provided an ethical guideline as Dharma for killing the enemy for one's king, one's nation and country, by sacrificing one’s life.
Wonhyo(A.D.617-686) has been revered as one of the greatest monks in Korea. First of all, he tried to independently adopt Buddhism from a Korean point of view. It is probable that Wonhyo’s positive interpretation of killing the living, ‘even if one commits murder, it becomes only a bliss, not a guilt’,
