| 摘要 | 이 글은 트랜스젠더(transgender)에 대한 불교의 입장을 성찰해 보기 위한 것이다. 논문은 트랜스젠더의 의미구명에서 시작하여 현재 우리나라의 트랜스젠더 이슈에 대한 불교적 응답을 탐색한다. ‘주어진 성을 받아들이지 못하고 반대의 성별을 추구하는 사람’을 의미하는 ‘트랜스젠더’는 우리나라에서의 트랜스젠더에 대한 통념－‘수술을 통해 성전환 할/한 사람’－보다 포괄적인 용어이다. 초기불교는 (자연적) 성전환 현상을 수용하고 이에 합당한 조치를 취함으로써 성전환에 의한 성정체성 변화를 인정한다. 대승불교에서 성전환을 의미하는 ‘변성(變性)’은 성별공성으로 인하여 가능하지만, 또한 똑같은 이유로 변성의 필수성을 거부한다. 대신에 이러한 변성개념은 ‘무집착을 전제로 한 변성’을 인정한다. 불교의 이러한 입장은 현재 우리나라의 트랜스젠더 이슈－성전환 수술의 인정여부와 성전환자의 성별변경 허용여부－에 대하여, 더 나아가서는 성전환자의 사회적 인정내지는 인권에 대하여 부정적이기보다는 긍정적 답변을 제시할 것으로 이해된다.
This paper aims at finding a Buddhist view on transgender. It begins with the meaning of transgender and searches for a Buddhist answer about the current transgender issue in Korea. ‘Transgernder’ as ‘one who does not accept his/her given sex and pursues the opposit gender’ is a umbrella term. So the Korean understanding of it, ‘one who changed or intends to change his/her own sex through surgery,’ is just one type of it. Early Buddhism accepts (natural) transgenders and treats them as gender－changed people. It accepts change of gender identity by a sexual change. Mahāyāna notion of transsexual(byon－song) is based on ‘emptiness of gender.’ Emptiness of gender makes byon－song possible and yet it makes byon－song unnecessary. This dual nature of byon－song accepts transsexual under the condition of nonattachment. It is understood that this Buddhist position provides a positive answer to the current transgender issue of sex change surgery and gender record change in Korea. Furthermore, Buddhism would advocate transsxuals’ social rights or human rights.
