| 摘要 | 교도소에서 출소한 사람들이 격리되었던 교도소생활을 하다가 사회로 복귀함에 따라 그 과정에서 급변하는 사회에 적응 등 어려움을 극복하지 못하여 범죄를 다시 범하게 된다. 본고는 출소자의 재범방지에 관하여 국내문헌을 검토한 바 국내연구는 아직 미흡함이 있음을 발견하고 출소자 재범방지 분야에서는 선진적 위치에 있는 해외사례를 소개한 후 그 시사점을 불교의 8정도(정견, 정사, 정어, 정업, 정명, 정근, 정념, 정정), 긍정과 부정의 두 가지 논리를 융합하여 보다 높은 차원의 가치를 모색하는 원효의 화쟁사상 등과 접목하여 결론으로 제시하고자 한다. As the ex-prisoners return to society after living in quarantined prisons, if they fail to overcome difficulties such as adapting to a rapidly changing society, they will commit crimes again. This article examines domestic literature on the recidivism prevention of exiles and finds that domestic research is still insufficient. In the field of prevention of recidivism of exiles, we introduce overseas cases in advanced position,, Which is a combination of the two logic of affirmation and denial, to find a higher level of value. |
