| 摘要 | Islam is the third of the monotheistic Abrahamic religions following Judaism and Christianity, both of which Islam recognizes and whose moral code Islam shares. Islam, however, has also developed a comprehensive system, the Shari’a, that covers all aspects of individual and collective human life. The primary sources of the Shari’a are the Quran (to Muslims, God’s very words) and the traditional teachings and deeds (Sunna) of the Prophet Muhammad. Issues not specifically mentioned in these two sources are ruled on by “analogy” (i.e., intelligent reasoning matching new issues with issues judged by the Quran or Tradition) and the unanimous consensus of Muslim scholars. When an issue is clearly settled by the Quran or Tradition, the verdict is final, for “It is not fitting for a believer, man or woman, when a matter has been decided by Allah (Arabic word for God) and His messenger, to have any option about their decision. Anyone who disobeys Allah and His messenger is indeed clearly on a wrong path” (Quran 33:36). However, the major part of Islamic jurisprudence is the product of human thinking responding to new events in new times and places. In its response, Islamic jurisprudence always heeds the five objectives of the Shari’a: the protection of faith, of life, of mind, of ownership, and of offspring. A basic premise in Islam is that everything is lawful unless it is otherwise specified by the Quran and Tradition or unless it conflicts with the objectives of the Shari’a. |
