| 摘要 | 原始宗教思想深刻地影響著原始人的生活。原始宗教思想對“習慣法”起了造模定型的作用。無論是古代印度、古希伯來,或且封建社會的伊斯蘭國家宗教經典《摩奴法典》、《摩西律法》和《古蘭經》都成為治國安邦的法律典籍,宗教經典成了法律的依據和基礎。縱觀歷史,古代受宗教思想影響而產生的法律,在法理思想上不完全健全,甚至有些扭曲與變形。表現在:集立法與執法於一身,人治大於法治;缺乏平等原則,法律不公。宗教法規反映法律的初級性特點。隨著生產力與科學技術的高度發展,物質文明與精神文明大幅提升,宗教對法制的影響也必然弱化。從歷史角度看,政教分離是進步現象,也有利於法律文化的健康發展。加強法制建設應當崇尚科學精神。 Primitive religious ideas on which "Conventional Law" is based have a great impact on primitive man's life. Whether it be in ancient India, ancient Hebrew, or Islamic countries in feudal society, religious Classics upon which law is based such as "Monu Code""Moxi Code" and "The Koran" have become legal documents to safeguard a country. Looking back on history, we find that law resulted from ancient religious ideas is not completely sound in legal principles, even deformed to some extent. It is mainly featured by the combination of legislation and law enforcement , greater power of man - governing than law - governing , lack of equality principles and unfair law. Therefore, religious rules reveal elementary features of law. However, with the development of productive forces, and science and technology, as well as the improvement of material civilization and spiritual civilization, religion’s impact on law is sure to be weakened. From historical perspective, the separation of politics from religions is a phenomenon to be praised, and is also conducive to a sound development of legal culture. St renghening law enforcement requires agreat attach to scientific spirit. |
